The question of when death occurs—whether by neurological or cardiac criteria—raises complex legal, bioethical, and risk management concerns, especially in the context of organ procurement. In this webinar, "Dead or Alive? Legal, Bioethical, ERM Issues Related to Death Determination & Organ Procurement," we will examine the evolving landscape of death determination laws under the Uniform Determination of Death Act (UDDA) and its proposed revisions (RUDDA). Participants will gain an understanding of the historical and current legal frameworks and the challenges they present for medical and ethical decision-making.
Through an in-depth case study, we will explore how to navigate situations where families disagree with brain death diagnoses, highlighting proactive Enterprise Risk Management (ERM) and bioethical consultative strategies. Additionally, we will discuss strategies for managing end-of-life (EoL) patients who are declared dead by either cardiac or neurological criteria, with a particular focus on organ procurement procedures, including the controversial practice of Normothermic Regional Perfusion (NRP).

- Understand the history of federal and state determination of death laws under Uniform Determination of Death Act (UDDA) and proposed revisions: RUDDA

Andrew A. Oppenberg, DPS, MPH, HEC-C, CPHRM, DFASHRM, DSA, (Andy) has decades of experience in risk management/patient safety, bioethics, and eight years of experience in various clinical and medical research arenas. Andy is a part time Professor in the Health Sciences/ Administration Dept. at California State University, Northridge. Andy’s consultancy firm, Asclepius Bioethics, ERM, Consultants also focuses on Patient Safety, IRB/Human Subjects Research and CME. Andy received a Doctorate in Biomedical Ethics and Public Policy from the Allen March Bioethics Institute at the Albany Medical College and a national certification as a clinical Healthcare Ethics Consultant-Certified (HEC-C) from the American Society for Bioethics & Humanities. “Uncle” Andy is Past President of both SCAHRM and ASHRM. He was ASHRM’s first Member Editor for our award-winning Journal and received ASHRM’s Distinguished Service Award (DSA) in 2015.

Mary DeLosReyes, RN, Esq., CPHRM, CPPS, is currently the Director of Enterprise Risk Management for Summit Healthcare in Northern Arizona. After 20+ years as a NICU/Labor & Delivery nurse, she became an attorney and practiced med-mal defense law before focusing her career in Risk Management. Mary has extensive experience as a boots-on-the-ground enterprise Risk Manager and health care attorney in a variety of health care settings with particular interests in patient safety and bioethics. She is past-president of SCAHRM and AzSHRM chapters.
