Many risk managers are tasked with varying roles within their increasingly complex organizations, including a role in litigation management and assistance with legal proceedings involving the health care provider. This presentation will provide an analysis of the importance of deposition testimony and strategies to assist with the preparation of health care providers for deposition and legal testimony. Risk Managers may work independently and in conjunction with defense counsel to prepare health care providers for their testimony in a deposition, trial, or other legal proceedings such as Workers' Compensation cases, criminal hearings, and Guardianship issues. Methodologies of the 4C's for deposition preparation will be discussed that can be utilized to assist with the preparation of any health care staff member, including management, IT or HIM department members, and other personnel involved in the litigation process. Strategies for practical and professional support will be addressed. 

Learning Objectives:

  1. Restate the importance of a deposition on litigation management and the method for successful health care provider preparation for deposition, trial, or other legal proceedings.
  2. Analyze situations in their own institutions where these witness preparation strategies could be applied to benefit the staff and organization.
  3. Define best practices used to prepare clinicians and nonclinical witnesses for litigation or other testimony.
